I. Information on the conclusion of contracts in electronic business transactions

2. Conclusion of contract in electronic business transactions

When you place an order, this constitutes a binding offer, which is equivalent to the conclusion of a purchase contract. Upon receipt of your offer, we will send you an e-mail containing a confirmation that your order has been received by us and an order overview with all details. Once this has been done, we will check the availability of the ordered items. Should one or more items not be available at the moment, we will send you a corresponding notification by e-mail that we cannot accept your offer. Items whose availability is guaranteed will be dispatched. Only by sending the ordered items does the binding acceptance of the offer come into effect. Please note that customers must be at least 18 years old to place orders.

3. Right of withdrawal

You are free to withdraw your order within a period of 7 days (without stating reasons in text form (e.g. fax, e-mail) or - if the item is delivered to you before the deadline - by returning the item.

Consequences of withdrawal:
In the event of an effective withdrawal, the services received by both parties must be returned and any benefits derived must be surrendered. If you cannot return the received goods in whole or in part, or only in a deteriorated condition, you may have to compensate us for the value. In the case of the transfer of goods, this is not the case if the deterioration of the goods is exclusively due to their inspection, as would have been possible for you in a retail store, for example. In principle, the obligation to compensate for value can be avoided by not treating the goods as your property and by refraining from doing anything that impairs their value. Products that have already been used or opened cannot be returned. The collection of the goods from your home is at your expense and risk.

In exceptional cases, the goods will be collected by LEOMAT AG or by a third party commissioned by LEOMAT AG. Please refrain from returning the goods without consulting us!

Note:
The right of withdrawal does not apply to goods that are manufactured according to customer specifications and are tailored to the customer's personal requirements. This includes all deliveries of products with labels or programming that we specifically produce according to individual specifications for individual customers.

II. General Terms and Conditions (GTC) of LEOMAT AG (as of Jan 2015)

The following provisions apply to all orders placed via the website www.leomat.ch and www.myleomat.ch. The GTC valid at the time of the order shall apply.

1. Prices / Availability

Our prices are always complete prices that include the statutory value-added tax valid at the time of the order.

For orders up to CHF 500, shipping within Switzerland is subject to a delivery flat rate of CHF 30 per order, regardless of how many items you order per order. For orders over CHF 500, delivery is free of charge.

For coffee from the beanarella range, the following applies:
For orders up to CHF 100, shipping within Switzerland is subject to a delivery flat rate of CHF 8.80 per order, regardless of how many items you order per order. For orders over CHF 100, delivery is free of charge.

Prices of the items displayed in your shopping cart at the time of order are in full agreement with those on the current product information page of the website.

It should generally be noted that special offers may only be available for a limited period. Furthermore, all offers are subject to the availability of the items. The price displayed on the website at the time of the order will always be charged. Each order is placed at the current daily price. We are not obliged to adhere to an incorrect price. An order does not yet constitute the conclusion of a purchase contract. Items marked "In stock" will be dispatched within 2-4 working days (Monday - Friday) after payment has been received or after creditworthiness has been approved.

Upon receipt of payment, you will receive a corresponding notification by e-mail.

Errors and changes excepted. All offers are valid only while stocks last.

2. Terms of Payment

Customers can choose to pay for the goods using the following payment methods:

LEOMAT AG reserves the right to exclude certain payment methods in individual cases. Payment by sending cash or checks cannot be offered. LEOMAT AG excludes liability for loss. To verify the address you provided, LEOMAT AG accesses the following credit agencies and their address data stored in the databases regarding your person.

Credit data is retrieved from: Deltavista AG, Postfach, 8034 Zurich. A credit check is only carried out if you have selected "Invoice" as the payment method.

We reserve the right, within our internal credit policies, not to grant these payment methods after a successful check. If you choose to pay by deposit, we ask you to transfer the full invoice amount without any discount within 10 days of the order confirmation to our account. Please indicate the purpose of use and order number. We ask for your understanding that in the event of non-receipt of payment after 7 days, your order must unfortunately be canceled.

If payment by credit card is selected, the debit will be made simultaneously with the dispatch of the goods. We accept Visa, MasterCard and Postcard credit cards. In addition, you can also use the online payment service PayPal to pay the amount. As a buyer, only a free PayPal account is required for payments with PayPal. To register an account on www.PayPal.ch, buyers only need to provide their account details once.

Subsequently, only logging into the PayPal account is required for further payment processes.

If you wish to pay by invoice, this is equivalent to the obligation to pay the invoice amount without deduction of discount within 10 days of receipt of the goods. In addition, only corporate customers with a residence in Switzerland can select the invoice payment method! Regardless of the payment method you choose, the invoice will be sent by e-mail. Please note that the order overview visible in the shop cannot function as an invoice.

3. Delivery Conditions

We do not undertake any obligation to meet binding delivery deadlines. After receipt of payment, the approximate delivery period for items available from stock is 2-4 working days. If the goods are items that need to be ordered, delivery can take up to 14 working days in some circumstances. Delivery will be made to the address provided by the customer. Once the goods have been dispatched, you will receive a notification by email or telephone.

4. Acceptance of Goods

The order will be shipped by LEOMAT AG or an authorized third party. If any damage is found to your goods, please do the following: If possible, report the damage directly to the delivery driver and document the extent and scope of the damaged goods. It is possible to refuse acceptance of damaged goods or to arrange a collection date with our customer service. However, please always contact our customer service. You will help us to assert our claims against third parties and at the same time improve the customer service we provide to you. 5. Retention of Title

The goods remain our property until full payment has been received. To assert our retention of title, we have the right to demand the immediate return of the goods subject to retention of title, excluding any rights of retention. This does not apply if there are legally established or undisputed counterclaims.

6. Force Majeure

If a case of force majeure (especially natural disasters) occurs, preventing us from performing the owed service, there is no obligation to perform for the duration of the hindrance. You have the right to withdraw the order if, as a result, delivery of the goods is not possible for more than one month.

7. Warranty

For some items, please note that we are not the manufacturer of the goods we supply. Should you wish to make claims under product liability law, we will immediately inform you of the name and address of the respective manufacturer upon request. In addition, you can make use of the statutory warranty rights if the goods are damaged or defective in any way (e.g. incomplete delivery).

If defects occur during the statutory warranty period, you can assert the statutory claims at your discretion. If, contrary to expectations, problems arise with your order, please contact info@leomat.ch. The websites are offered in a design that we deem appropriate. We do not guarantee that they will meet your personal requirements and will be offered at all times without interruption and errors, in a timely and secure manner.

Use is at your own risk; we are not liable for the consequences arising from the use of the websites and for the accuracy of the information disseminated.

8. Protection of Intellectual Property

The content of the websites is protected by copyright law and other protective laws. This applies to all images, texts, graphics, animations and videos, including their arrangement. These may not be copied, altered in any way, distributed or made accessible to third parties. In addition, some of our websites contain images that are subject to the copyright of third parties. Unless a corresponding notice indicates otherwise, all trademarks are generally protected by trademark law. 9. Storage of the contract text

When the order is completed, the contract text can no longer be viewed as it is not stored by us. However, it is possible to print out the order data directly after submitting the order.

Tübach is designated as the place of performance and jurisdiction for business transactions with companies and legal entities under public law.

In order for LEOMAT AG to provide its internet services in a customer-oriented and appropriate manner, it is dependent on collecting and using customer data. Collection and Storage of Usage Data
